NOTICE OF PENDENCY OF ACTION

NOTICE IS HEREBY GIVEN that the Plaintiffs in the above entitled cause, Jay and Penny Carroll, filed in the District Court of Catron County, New Mexico, their Complaint To Quiet Title against the above named Defendants, together with the Affidavit of a competent person that, upon diligent inquiry, the addresses of the above Defendants, the Estate of J.S. Smith, and All Known and Unknown Claimants of Interest in the Subject Property, and the last known address as cannot be determined by Plaintiffs; that a cause of action exists against all of the Defendants; that all of said Defendants are necessary parties to the action; and that said action is instituted and prosecuted for the purpose of quieting title as against all Defendants, claims, and claimants whomsoever and against the world to the following described real estate in said complaint, and situate in Catron County, State of New Mexico, to-wit:

E ½ S ½ S ½ of Section 9, Township 2 North, Range 13 West, N.M.P.M.

NOTICE IS FURTHER GIVEN to each and all of the said Defendants that you must answer or otherwise respond to the Complaint in writing on or before thirty (30) days after the last publication of this Notice, and if you fail to do so, a Judgment may be entered against you upon your default for the relief the Plaintiff has demanded.
