NOTICE OF SALE ON FORECLOSURE

PLEASE TAKE NOTICE that the above-entitled Court, having appointed me Special Master of this matter with the power to sell, has ordered me to sell the real property situated in Socorro County, State of New Mexico, more particularly described as follows:

Lot Numbered Four (4) of the Abbe Springs Development Phase 1, as shown

on the Plat thereof on file with the Office of the Socorro County Clerk

New Mexico on June 27, 2001 at 8:25 am in Plat Book C at Page 187.

(hereinafter, the (“Property”)

The Default Judgment appointing me Special Master and directing me to sell the Property was entered in the above-entitled and numbered cause on November 21, 2022. The sale is to begin on January 31, 2023 at 10:00 a.m. on the steps of the Socorro County Courthouse, 200 Church Street, Socorro, NM 87801, at which time I will sell to the highest bidder for cash in the lawful currency of the United States of America, the Property, to pay expenses of sale, and to satisfy the Default Judgment entered in the above-entitled action in favor of Plaintiff, which are owed by Defendants in the amount of $1,503.03 as of filing of the Complaint, plus attorney’s fees in the amount of $800.94, including New Mexico Gross Receipts tax thereon, plus costs in the amount of $425.78, for a total judgment of $2,729.75. Interest will accrue from November 21, 2022 until date of sale, at the rate of 8.75% or $15.19 per diem. The final judgment will include additional costs and attorney’s fees incurred through the foreclosure sale of the Property, plus $500.00 plus New Mexico Gross Receipts tax thereon for the Special Master’s fee, plus publication costs. Plaintiff is allowed to bid the amount of its Judgment, or any portion thereof, at said sale as the equivalent of cash.

The Property may be encumbered by other liens which were not foreclosed by this action, or may be subject to payment of taxes or other assessments, and, any purchaser of the Property shall take the Property subject to such liens, taxes, assessments or other encumbrances.
